Attention self-proclaimed Constitution lovers in the GOP: If the founders wanted direct elections of Supreme Court justices, they would’ve put that in there.

Obama should make a recess appointment right before he leaves office. And, short of that, Hillary (or Bernie) will get to make not 1 but maybe 4 appointments to the bench during her/his first term. The GOP is so royally screwed and if the Dems have any hair on their butts, they’ll crush the GOP with very liberal justices.

Actually those aren’t rights they’re duties. The Senate has no Constitutionally mandated right or duty to obstruct a qualified nominee for political purposes. The don’t have a “right” to do that. They can do it and they will but their purpose is putting the “American People” into the process via their elected representatives.

The American people are involved…they elected the President and they elected the Senators. And lets not fool ourselves. These GOP’ers don’t give a shit about the American people. Many of those people want Obama’s choice vetted and confirmed if qualified. The GOP’ers care only about GOP’ers and keeping the Court a validating outfit for all things Conservative. Without that Court they don’t have shit.

And why wouldn’t this 'principal apply in a mid term appointment? Why not delay them all until you get a POTUS that will give you a SCOTUS you like?
