That depends on how long it takes the Trump University fraud cases to reach the Supreme Court. They will eventually since Trump will lose them and he will not give up on them until the last appeal is exhausted. If she is planning to retire before this happens then she wonāt hear a case involving him (unless there is a Trump v. Clinton to complement Bush v. Gore). Otherwise ā¦

For everyone with short memories, do you recall the criticism that Justice Alito got for mouthing the words ānot trueā in response to President Obamaās criticism of the Citizens United decision in his State of the Union address in 2011? The Justices live and work in a self-created bubble that is supposed to insulate them from crass political concerns, as if they were the Vestal Virgins or monks. While that has always been a fiction (one that we members of the public treat as if it were real, as shown by the howls when we get a nakedly partisan decision such as Bush v. Gore or Shelby County), itās also a tradition with the Court. And the Supreme Court takes its own traditions and its reputation for being above dirty electoral politics seriously (most of the timeāsee the former parenthesis for the most obvious exceptions). So itās not surprising that RBG issued a mea culpa for expressing her opinions on politics; the apology is to her fellow Justices, rather than to you or me. And definitely not to Trump.

Thatās true until itās not. Remember how it felt like Obama was in a free fall after the first debate? He wasnāt. The election never changed, the polling never changed really. Sure it moved around according to events, but his campaign has repeatedly commented how remarkably stagnant the election remained. Bad polling the week before a convention, polling which still has her ahead, isnāt cause for great concern. Nobody has even announced their VP picks, there hadnāt been a convention or a debate. And last I checked minorities still get a say in this election and weāre being badly under polled.

RBG originally spoke the truth, something Repubs donāt do. She then demonstrated humility (she didnāt apologize, by the way), also something Repubs donāt do.

Whether youāre identified as a Dem or not, you gain NOTHING by taking the abuse that the RW doles out to you.

Taking the high road or being the adult in the room has gotten us where we are now. Now, Iām not saying that every liberal should turn into some version of Gohmert but you have to stand up, in some form, to them if youāre telling the truth.

Look, I adore RBG and I loved hearing her give him the what for. I literally hate Trump, truly, so I just enjoy hearing anybody go in on him. That said, Iād be lying if I said I wasnāt also uncomfortable with a SCOTUS justice leveling this kind of criticism at a presidential candidate. It did feel a little wrong. Today, itās one of my favorite judges going after my most hated presidential candidate in my lifetime, but tomorrow it could be Thomas going after, say, Kamala Harris. Shoe, other foot kind of thing. While I wouldāve much preferred if sheād just let the whole matter drop without further comment, I canāt at all even begin to disparage her for showing the class and dignity I love and respect in her.

I bummed she had to make a statement on this because her sentiments were 100% true. RGB has been fighting for progressives for her entire career and one statement is never going to change that for meā¦and letās be real, this is the equivalent of saying: I regret yāall didnāt like what I said. #sorrtynotsorry.

Itās a new phenomenon when we see unapologetic partisanship on SCOTUS such as the duck hunting incident where no apologies were issued only scorn of the criticism leveled at it. Ginsburg has deeply held feelings about the direction of country under the demagogue waiting in the wings, and she spoke up, perhaps inappropriately. Would that trumpet were to ever acknowledge he had misspoken unwisely.

Except for the fact that itās already happened. Itās not as if RBG did something that was totally unprecedented. The RW bench already opened that door during Pres. Obamaās tenure in the WH.

She did nothing of the kind.
She didnāt even apologizeānor did she say she was wrong, or that her statements were untrue.
She just regretted her remarks, which is the classic non-apology apology.

To those who question it, how would you like it if Alito gave an interview where he suggested that Clinton should have been prosecuted and if he was the judge, heād have found her guilty of gross negligence?
