Judge not, lest ye be judged.

Here’s the Democrats’ best play: they should put KAVANAUGH on the spot, as a matter of his judicial philosophy and temperament. It’s not about him – there’s a witness who claims to have been the victim of a crime. There’s an accused.

And there’s ANOTHER witness.

As a core matter of due process, that other witness must be put under oath to testify. It doesn’t matter if that witness supports the accused, or the one claiming a crime. The record is simply not complete without that third person’s sworn testimony.

If Kavanaugh refuses (why?), he’s simply unfit to serve as a Justice on the US Supreme Court.

The Republican Majority in the Senate represents 18% of the population from mostly white rural states. That 18% controls the lifetime appointments to the Federal Judiciary.

This is America’s so-called “Representative Republic.” This is America’s so-called “Checks and Balances.”

All legal. All Constitutional. Nothing we can do.

One awkward thing for this whole scandal with the GOP is they keep saying “Hey, he was young and stupid! Things happen!” but Kavanaugh is claiming it never happened. Talk about mixed messages

Coryn reserved judgment, noting that there were “gaps” in the memory of Kavanaugh, who could not recall ever meeting Pryor when considering him for a nomination while working at the White House, despite multiple e-mails he sent and received regarding the nominee.

SO accuser doesn’t KNOW if she was THERE but KAVANAUGH and THE OTHER GUY WAS there. KAVANAUGH wasn’t THERE but IF HE was HE DIDn’T do anything becauSE HE’s GOT daughters for christ’s sake. THE OTHER guy was too drunk TO REMEMBER IF HE WAS there but wasn’t there. KAVANAUGH is the real victim because it happened 37 years ago and WHO among US CANNOT say WE DIDN’T do drunk rape, attempted or otherwise, when we were teens BECAUSE prep school boys like to drink and rough house. And the accuser was dressed LIKE A SLUT in a one PIECE bathing suit.

I don’t think this hurts our cause as much as some seem to think it does. Other than the questions about how BK can claim he hadn’t attended a party for which she never provided the location or date, much of what he says won’t matter. He’ll be thoroughly coached and ready for the questions. Those in DC and around the country will be watching to see how credible she is. Like it or not, the onus is on her. Does she come across as a sane, competent, respectable individual with little reason to make up such a story? Is she able to provide names of people she disclosed to prior to his nomination? Is she able to provide any other contemporaneous evidence? The most damning piece of evidence to me are the therapist notes, but I suspect GOPers will try to use the fact that she was seeing a therapist to suggest she’s unstable.

“She doesn’t know how she got there,” Cornyn said, “And so that would logically be something where she would get questioned.”

She doesn’t REMEMBER how and with whom she traveled to a party some 30 years ago. That’s not unusual. It’s not weird not to remember the more mundane details that occurred prior to a major trauma, you asshole. Ask your wife what she had for breakfast the day she gave birth to your children. Bet she doesn’t remember, but I’m guessing she remembers the birth.

I’m working on the assumption that Ms. Ford will show up and testify on Monday. As unfair as it is, there is not a lot of leverage for negotiating a delay, more witnesses, more investigation, and the like. If for whatever reason she does not show Monday, it will be a straight party line vote for confirmation. If she does show on Monday and we get a he said / she said, there is a good chance to peel off two votes from the other side. More importantly, the optics of that hearing will be devastating to the other side in November. It is entirely possible that once she agrees to testify, they withdraw the nomination.
