This is perfect.

The law of rescission and restitution, which technically would determine whether Cohen has to take the money, is totally secondary here.

The whole point of this contract was to intimidate Stormy (and everyone else who has signed them) into keeping their silence at all costs.

It was never about actually testing the agreement in court, because the minute someone gets up the nerve to expose the whole sordid deal, Trump has lost. And the more ways they can keep the issue going, the worse it gets for him.

And this is the guy who will make a great deal with North Korea??!!

Bookings for her in clubs and strip joints, which is where porn stars really make their money (at least the money that they declare to the IRS) are already way up. She may even get a book or movie deal (a non X-rated one). That will be retirement money for her.

LOL…he’s trolling Cohen and Trump. Sure, this is a settlement offer and responsible attorneys and their clients make them when it would save everyone the headache and costs of the litigation, but he knows Cohen…and more importantly Trump…isn’t going to accept this. I like how he put in there the language about her wanting to publicly talk about their attempts to silence her haha…he’s totally tweaking their nips.

Interesting. I read this the other way-Daniels is exposed and going to lose. This is grade A public relations, but grade D contract law. She entered an agreement to remain silent and turn over particular information in exchange for payment. The fact that she now could get more value out of the arrangement does not mean that she can have the money back–think about stock sales, for example. There’s nothing illegal about NDAs.

The arguments that the president “won” from the white house podium seems to be a lot more probative re: whether the agreement still exists and whether Trump waived his rights. In addition, the $1million in liquidated damages clause could be viewed as an unenforceable “penalty” (and it might not be–it’s been a while since I looked at that).

Putting the emotion of who the object of the NDA is aside, there seems to be lots of good reasons to enforce it. The CBS part of it, though, is something that the white house won’t be able to touch without a massive (and likely unsuccessful) First Amendment brawl.

Hello Lawyers in the Audience, is this simply a step her legal team has to go through before they can successfully sue to have the agreement terminated?

I mean, Cohen & Traitor Donald ostensibly believe Clifford’s silence to be worth at least $130k (or more) or they wouldn’t have drawn up the contract in the first place. It would seem a foregone conclusion that they’ll say no to this offer to end the agreement. So why make it?

I hope Avenatti is signing up many more clients who have such deals with Trump and Cohen.

It does, but if Clifford decided not to pay it, then Team Traitor would have to take her to court in front of an actual judge to collect - not just some arbitration hearing with an arbitrator on their payroll.
