They’ll try and block any nomination until after the November elections. Wow though – can’t say I am sorry for his passing.

In the near term, and as long as the court stays divided 4-4, rulings made by the lower courts will stand. This will be a good thing or a bad thing depending on how the lower courts rule on certain issues, but effectively, it means that the Supreme Court has no power until they get a ninth member.

I have a hard time imagining the Republican controlled Senate approving anyone Obama appoints, so this appointment gets very political as we face an eight member court for the next year. Frankly, it is hard to imagine a President Clinton or Sanders getting their way either - so are we stuck?

Or has this just presented an opportunity for Obama to make a “West Wing” move, in which he encourages Justice Ginsburg to step down, and thus, give the Republicans a chance to appoint someone they like, and Obama someone he likes?
