Discussion: READ: Whitaker's Prepared Remarks In Front Of House Judiciary Committee

Shorter Whitaker: “Everything at Justice is peachy. Now can we talk about the wall?”

The Committee’s performance today may make or break Democratic Voter expectations for the next cycle.

Energize the voters with vigorous oversight and they’ll turn out; disappoint with ‘business as usual’ and they’ll ask themselves why bother.

Long-standing? The first time I heard this goofy concept of future-proof executive privilege was when Sessions cited it a couple of years ago. What bullshit

The stupid son-of-a-bitch. Doesn’t he get that, when Nadler slaps him with a subpoena in the hearing chair, Fat Nixon will deny ever meeting him?

Either invoke executive privilege or not. Shit or get off the pot. If Nadler and company don’t get him to invoke executive privilege they better follow through with the subpoena or there will be hell to pay. I am tired of this circus and so are all Democratic primary voters.

I thought only the President could exert executive privilege. He can do it for his conversations with Whitaker, but Whitaker can’t invoke it on his own? Or do I have this wrong?

The committee better have been ready for this bullshit line of defense

Poor idiot, I still can’t see any benefit to be accrued from him serving as acting AG, he did shit, so trump can’t be very happy, democrats truly hate him and are going to do their best efforts to screw him, and the Wingnut Welfare Network is really getting stretched with so many ex-staffers in need to be quiet,

Nope you’re right. That’s why the committee gave Whitaker days to consult with the office of the President (if necessary) and invoke privilege on any matter. The most relevant point being executive privilege doesn’t automatically apply to every utterance from the President’s mouth, and needs to be explicitly declared. I’m obviously not a lawyer so this analogy is perhaps not the best, but I think of it a bit like pleading the fifth. A defendant doesn’t get to arbitrarily choose what they do and don’t respond to – they have to explicitly declare they’re not responding to question xyz because they’re invoking their 5th amendment rights. Likewise the Presidency has to explicitly say “the contents of such-and-such a conversation are subject to executive privilege.” When requested to do so, in advance. Just like the committee did.

Whitaker’s opening statement is touting the huge drop in murder and other crimes, undermining his boss’s assertions of a bloody wave of carnage sweeping across the nation.

Oh, and then he follows up by regurgitating Donnie’s “immigrant women in bondage” talking points/fantasies and attributing all remaining violent crimes in the US to shifty and murderous migrants.

Whitaker Signals He’s Prepared To Cite Executive Privilege…

I bet he is!

Lex Luther says he’s covered by ‘executive privilege’.

The House takes him to court to testify.

The Courts rule temporary and acting executive branch employees not confirmed by the Senate are NOT covered by ‘executive privilege’.

McConnell’s Senate goes into overtime to confirm Cabinet posts- but trump hasn’t nominated anyone.

Putin and Xi crow. trump uses ‘executive time’ to watch TV and tweet his outrage at Democrats.

Rinse and repeat.

In his prepared remarks in front of the House Judiciary Committee Friday, acting Attorney General Matt Whitaker signaled that he planned to avoid lawmakers’ question about his conversations with President Trump on the grounds that the President may seek to invoke executive privilege on those topics at a later date.

Somebody really wants to be first Republican admin official to be subpoenaed. :smirk:

Theories:

  1. This was a fumbled #TimesUp. Whitaker is secretly the leader of all feminists worldwide.
  2. He’s trying to goad Nadler into dropping the subpoena, either for cheap political points or because he hopes the immediate legal battle will run out some kind of clock.
  3. Mr Big Dick Toilet Salesman is just out of his depth and has no plan or tactics.
