Well, heâs right, isnât he, as far as he went? She has a right to her beliefs. But the Pope did not comment on whether she could both follow her conscience and keep her job. Very different question. And the Pope is not, and does not pretend to be, and expert of the American legal system.

I heard a rebroadcast of This American Life on Saturday. Dan Savage was talking about his motherâs death, and her nature as a devout Catholic. (Itâs episode 359, I think. Definitely worth the time for the podcast.) When (JP)^2 or Bennie popped some sort of craziness (like, contraception is a sin, women will never be ordained, etc.) she said, âItâs as if theyâre trying make us all Lutherans.â
Two things in response: this is Francisâ first, âTrying to make you all Lutherans momentsâ and, (sadly) we have our share of crazies in the Lutheran church, too.
The Pope said it was a HUMAN right, not a legal right. It was always âfineâ for her to have her beliefsâŚit was not fine to disobey the law.

The Council of Bishops has already told the courts that they donât need to appear because they report to a higher authority. Christians are waging war on the legal system of the US and claiming that they are under attack. This may end up very badly because it is beginning to look like the 1850âs.
Itâs not a right when itâs what youâre paid to do and what that is is follow the law. She also has the right to get a job in which the duties in the job description match her abilities.
Maybe she should go live inside vatican city if she wants this ârightâ.
The issue whether never whether Kim Davis had a right to be a âconscientious objectorâ when it came to personally issuing marriage licenses to same-sex couples - she was offered numerous outs that would have allowed her to not do so personally.
The issue was that, in her position as County Clerk, she attempted to stop her office from issuing them - threatening to fire any staff member who processed them, challenging the legality of any licenses issued without her signature, and adopting a policy that no licenses (to any couples, gay or straight) would be issued by the office because of her personal objection to the court ruling.
She wasnât a âconscientious objectorâ, she was the modern day equivalent of George Wallace standing in the county courthouse door to deny civil rights to others. There is a huge difference.
Heâs correct. Itâs a human right. He didnât say itâs a legal right. Different things. She has the human right to not issue licenses, she just doesnât have the legal right to not issue licenses. His remarks are entirely consistent with âdo the job or resign.â
