Discussion: Penn. GOP Files Federal Lawsuit To Allow Out-Of-County Poll Watchers

Just telling you how it worked when I was a poll watcher. The precinct officer is an agent of the county. The poll watcher accompanies that agent to ensure that the ballot box arrives at the counting station un-tampered.

“supposed…intimidation” being the keyword here.
From every report I read, the only people "intimidated’ by the presence of the NBPP at that Philly precinct were white Republicans, probably self-appointed “poll watchers”, who went to that location with no legitimate explanation for why they were there.

I cannot wait until I am able to retire from my Fed job and get involved more in elections. Hubby has been a senior election judge for years (I stayed home with kids, now with dogs, LOL). BTW, he said poll watchers can insist that local records be checked against main database which will eat up a lot of time. If they challege too much though, he can throw them out as detrimental to an orderly election.

Someone has to take the voter machines and the ballots to the central location where the official count takes place.

Usually that someone is the head of the precinct and by definition that person is partisan but they take oaths, too.

they’ll be armed and wearing cowboy hats.

If there was time, and I was defending, I’d require plaintiffs to produce evidence of the kind of voter fraud they allege. Just to watch them twist in the wind.

Why stop at county lines? If the First Amendment of the U.S. Constitution is violated by limiting poll watchers to county residents, is it not also violated by blocking out of state poll watchers?

A bogus suit filed to keep public attention on non existent voter fraud. It will be voluntarily dismissed soon after the election. Assuming the purpose of the law is to prevent organized voter intimidation, the law is rationally related to the purpose it serves, and there is no constitutional right for anyone to go anywhere to “poll watch”.

Election judge in my living room: "They are not counted at the poling place. . They are taken to the county and are only counted if margins are close enough. Same with absentee ballots.

Terrific set of facts, but HOTOG’s base don’t do facts. It is all about hate, mistrust, and intimidation. Anyone of his “watchers” that show up will not be allowed past the electioneering limits. It’s outside that they will do their damage: in the parking lot, on the street, walking along the lines.

Well, in Turner v. Cooper, 583 F. Supp. 1160, 1161-1162 (N. D. Illinois 1983), a federal court held that the act of poll-watching is not protected by the First Amendment.

In the mean time, Trump is in PA saying:

1 in 5 Americans who are working age are out of work (that’s 20% percent unemployment – who knew?)

Voter registration = voter fraud (citing Pew Research stats about registration roles with dead people on them or where the system hasn’t caught up.)

Totally agree - the judge who gets this should stamp a big “REJECTED” on the brief, then throw the lawyers out for wasting the court’s time.

Only the dead people that are paying their taxes should be allowed to vote… dead people that aren’t paying their taxes should be unearthed and put in jail.

No, they are PARTY agents. In MD, the two election judges tally and reconcile the votes and count the provisional ballots. They phone that number in. A third party picks up the ballot boxes and provisonals but does not get the tally. The judges stay behind to close up the polling place. No one goes with the ballots, not a judge, certainly not a watcher…

This is not limited. It is a national issue for the GOP. It has been in place since 1982. Though it stemmed from GOP voter suppression in NJ, it applies to GOP voters suppression anywhere. It was supposed to be lifted next year. Thanks to Trump, no matter what happens Nov.8, this baby isn’t going anywhere. My guess is there will be be additional sanctions on the GOP after this fiasco. They clearly have a deplorables issue.

I’m all for school choice (REAL schools, of course)–for the progeny of Trump supporters. Schooling would only help the uniformed dontcha think?
