Discussion for article #229474
So stupid. The desist order simply heightens the reporting and ensures that âanonymous YouTube usersâ will continue to republish. If they canât keep copyright music material off Youtube, thereâs no way they can keep Kasichâs meltdown off Youtube.
"17 U.S.C. § 107
Notwithstanding the provisions of sections 17 U.S.C. § 106 and 17 U.S.C. § 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:
- the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
- the nature of the copyrighted work;
- the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
- the effect of the use upon the potential market for or value of the copyrighted work."
Plunderbund should tell these despicable fucks to go pound sand. PD published it, put it in the public sphere and now someone is reporting and commenting on it (one might even argue that giving the information to everyone else so they could discuss it was the entire purpose of publishing it in the first place). The only reason they want it removed and to pretend it never existed is because itâs an embarrassment to them and calls into question the newspaperâs credibility and ethicsâŚwhy, after being front and center to such a horrible display of candidacy during their own interview, they would still go and endorse the miserable twerp (answer: $$$). Iâm wondering how much collusion you could find under the hood here.
I suppose the ânewsâ media can run around shouting with its hair on fire that itâs supposed to be able to publish whatever secrets, no matter how dangerous or damaging, that it gets its hands on in order to âkeep the govât [or everyone else] in checkââŚBUT GODDAMN YOU IF YOU SCRUTINIZE THE âNEWSâ PURVEYORS AND TRY TO KEEP THEM IN CHECK.
Just another example of no guts masquerading as âdiscussing options.â
Then it takes an anonymous guy to put the thing right back up again.
How many times can you write âliberal blogâ in one article?
this is news. I think Sniffit has outlined why you cannot copyright the news.
Ahh those pesky newspapers and their constant fight against the 1st Amendment.
Streisand effect, please.
Some people just canât afford the âlawyeringâ this may take.
I wonder what happens if the blog provides a link to the YouTube video.
Wow. Busted, now digging hole.
This wonât end well.
The video has been taken down on Youtube now as well.
I must say, thereâs no way I would ever advise a client to risk a 150K judgment plus attorneys fees on the bare hope that he might get a federal judge to rule that appropriation of an entire copyrighted work constitutes fair use under any circumstances. Especially given the high risk that the judge will be a Reagan or Bush appointee.
If they wanted to do it, Iâd take their case gladly, but I would advise them to take it down. Not unless theyâre independently wealthy.
hahaha⌠and now these dolts will guarantee that the video gets wider distribution than it would have otherwiseâŚ
That was inevitable. The DCMA is as it is.
The story indicates they posted âpartsâ of the video, not the video in its entirety. IANAL so I donât know if that makes a difference.
It doesnât really matter anyway. It made it on the internet, itâll never go away entirely if people want to keep it available. I guess NOMG has never heard of the Streisand Effect.
I canât see the video, so because of The Plain Dealerâs chickenshit behaviour, I get to use my imagination which provides a very clear picture of a totally incompetent and incomprehensible and irrational Kasich just barfing up some useless dreck during an interview with The Plain Dealer of Cleveland, OH. After which, the Plain Dealer shrugs, endorses the lost and confused governor anyway just because heâs who he is and they are who they are and then decide to just shut that whole thing down.
Well done Plain Dealer. Kasich screws the pooch and you him anyway. Heâs such a lucky guy.
I just went there. It is gone.
pulled off youtube now.
Hope it appears somewhere else!
PD: journalism :: Kasich:responsive politicians. two peas in a pod.
