This whole chain of events — and the other records and deposition
produced in the litigation around the move — prompted three separate
courts to rule that Ross’ conduct violated the Administrative Procedure
Act. Those decisions, and whether the question stays on the 2020 census,
are being reviewed by the Supreme Court.

The conservative majority of that court seemed entirely uninterested in the violation of the Administrative Procedure Act when the case was argued in open court.

I am unable to confirm rumors that the newest member of the court suggested that the Administrative Procedure Act was probably drinking at the time of the supposed violation and has a reputation for being a little “loose.”

When you sit back and look at the whole panorama, the lawlessness is shocking, as is the fact that so many people in the executive branch are going along with it. It’s really impossible that all of the political appointees don’t understand how this is working, and don’t see how far out of bounds they are. It makes you wonder why they think it’s just fine to go along with all of this…do they not understand the law, or have they just decided not to care anymore because they have the power?

The bigger question is at what point the civil service decides it has had enough of illegal shenanigans and starts leaking information. That’s obviously been happening in other areas, and a lot of them know what is going on is wrong. Yes, they have a duty to be non-partisan, but at what point do they decide it’s time to step in and stop the abuses of power? Hopefully they aren’t waiting for the Democrats to take over in 2020…that could be too late, even if they win the election.

Not possible. The Census is a Constitutional commitment.

Redoing the Census is not unconstitutional.

“Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons. The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct.”

This stipulation is not in effect now.

Democrats are laughed at and mocked by republicans because Dems have proven to be all bluster. Our government is broken so badly that we citizens are the proverbial frog being slowly boiled in water. Folks, there is no one willing to stand up to the lawless republicans and we’re fooling ourselves to think Pelosi/Schumer will do anything about Trump’s brazen, unconstitutional attacks on our democracy. The bipartisan effort to stop Nixon was the last time our government worked worth a damn. We’re now a banana republic along the lines of the Philippines (or take your pick). Trump will be re-elected and America will slide further into the dust bin of history.

One key point, in reference to “lawlessness” in general, is that with Commerce asking DOJ to “request” that a question on citizenship be placed in the census, there is a clear implication that answers to the question might result in action by law enforcement against those who honestly answer. It is absolutely forbidden for the census to be used in this way and casts doubt over the impartiality of the census and is likely to depress the overall rate of response.

The GOP’s obvious intent is to undercount people in urban areas, artificially increasing GOP representation in Congress.

The census is conducted for the decade… it can be supplemented, but not redone.

Never mind the Census:

US President Donald Trump’s businesses lost a total of more than US$1 billion from 1985 to 1994, according to the New York Times, which said it obtained printouts from Trump’s official Internal Revenue Service tax transcripts.

The newspaper said Trump posted losses in excess of US$250 million in both 1990 and 1991, which appeared to be more than double any other individual US taxpayer, based on IRS data.

Trump lost so much money that he was able to avoid paying income taxes for eight of the 10 years, the Times said.

The White House did not immediately respond to a request for comment.

SCOTUS will rule, and all of the other courts’ rulings will be so much wasted time.
