As the lawyer representing the three women wrote in a filing accompanying the settlements, Mackris’ agreement “requires Ms. Mackris to lie — even in legal proceedings or under oath — if any evedence becomes public by calling the evidence ‘counterfeit’ or ‘forgeries.’”
Well, now … that’s … interesting.
If I was the judge, I would vacate the confidentiality portion of the claim and refer the lawyers who drafted or defended the agreement for disciplinary hearings.
Is that even legal?
Also: Can the lawyers (or arbitrators) who formulated that not be somehow violating ethics or the law??? Seems to me that whoever drafted this should have advised against it or refused to include it in the wording. (Of course, IANAL, but it just seems wrong on so many levels.)
What say you, o wise one??
There is no falafel.
How in the hell can a requirement to perjure oneself be written into a legal contact? WTF.?
It’s not and I can’t believe they did this.
Exactly! These lawyers should be disbarred. On the other hand, this will give O’R and opportunity to sue his lawyers for malpractice. AND the women should get piece of the lawsuit against their lawyers as well!
Pleasepleaseplease let Billo try and sue SOMEBODY over this, thus keeping it alive. He’s dumb enough.
Once the toothpaste is out of the tube, Billo, YOU…CAN’T…PUT…IT…BACK!!
I’m no lawyer, but sounds like an illegal contract in that it has contains unenforceable conditions.
…or be binding on the signatories?
It is. You can’t contract someone into committing a crime legally.
Subornation is, apparently, only a criminal offense when a lawyer doesn’t get a cut from the transaction.
As Michael Cohen wonders…“Why didn’t I think of this? It sure wasn’t on the LegalZoom Settlement/NDA/Hush Agreement I printed off the internets.”
You ain’t seen nothing yet: Her lawyer, the infamous Ben Morelli, changed sides — he agreed to represent O’Reilly — while negotiating the Agreement.
So, there’s no such thing as a contract killer?
No true! Mobsters put out contracts on people all the time. Oh, wait…
I think there was something in one of the articles that hit yesterday (sorry, am unable to quickly lay my hands on it), that one of the lawyers who helped draft this thing later moved into O’Pigly’s stable of tame lawyers, kind of like the thing that happened with Stormy Daniels and others.
Wish I could find it – if I can, I’ll edit this.
ETA:
Oh, I see that @cervantes beat me to the punch (again!).
O’Pigly’s sty is really stinkin’ at this point. I hope he and all of his crooked cronies get so buried in their pigshit that we never hear from O’Pigly again.
I see that both our minds were in the same dark place.
Sure - but is it legal? You tell me.
