It is rare the a Supreme Court nominee dies in the last year of a presidentâs term, and never in the modern era has that vacancy needed to be filled when an opposing party controls the Senate.

So Obama picked a candidate who is in every possible way calculated to undercut every hysterical argument and anxiety they were planning on firing up to put the sheer hypocrisy and pathological cynicism behind McConnellâs move into high relief.

I think this is a sign that Obama knows that the GOP is going to take this to the bitter end. Garland may not be progressivesâ favorite by any means, but he is smart, has a long unexceptionable record, and is not certifiably insane. If McConnell and Grassley are unwilling to confirm him, they really have to play the âWe wouldnât confirm Jesus Christ mashed up with John Marshallâ game. And thatâs (we all hope) a senate-losing and white-house-losing move.
There will be far less to object to since we have white and the XY chromosomes in this nominee.

Iâd like to think Obama is saving him rather than Sri taking himself out of the game. But regardless, Merrickâs willingness to pick up this cross is nothing short of heroic.
No way? Hereâs a scenario:
The Republicans control the Senate.
Hillary is President.
She nominates Obama.
The Republicans say no, and the position goes unfilled until at least 2021.
It shows Merrick to be a man of principle who respects the Constitution and the Presidentâs clear duty to appoint to the Supreme Court. In contrast, the obstructionists have eagerly seized the opportunity to gain advantage at the cost of trampling the constitution which they purport to hold dear. The upcoming showdown will be ugly â but both the principle and practical effect will be very starkly illustrated.
