Logic means nothing to a conservative judge who’s already decided to overrule the law based entirely on his own religion or ideology.

I read this on another blog: From the Fourth Circuit Ruling (page 46 of 46)

What they may not do is rely on our help to deny to millions of Americans desperately - needed health insurance through a tortured, nonsensical construction of a federal statute whose manifest purpose, as revealed by the wholeness and coherence of its text and structure, could not be more clear.

I think that’s better.

It’s not really that hard to figure out. Conservatives are always screaming that they hate judges who legislate from the bench.

Of course it’s always conservative judges who do it.

The GOPers are pettifoggers.

The law states that those who buy insurance on the state exchanges are eligible for federal subsidies.

The law also says that the federal government may act in place of the states if the states don’t create their own exchanges.
Logic—something unknown to the vast majority of conservatives----tells us that acting in place of the states means that the subsidy provision carries over to that action.

It ain’t rocket surgery.

No case stands for the proposition that literal readings should take place in a vacuum, acontextually, and untethered from other parts of the operative text; indeed, the case law indicates the opposite.

Apparently, Judge Davis has never read Scalia’s interpretation of the Second Amendment as rendered in his decision in Heller v. DC. There, Scalia’s reading could only be achieved by reading it “in a vacuum, acontextually, and untethered from other parts of the operative text” (and with the help of a secret 18th-century Wörterbuch that only he has access to).

He didn’t just troll Obamacare opponents. He utterly demolished the entire statutory construction philosophy (applicable only to statutes passed by Democratic Congresses and signed by Democratic presidents ) of the Federalist Society with a simple analogy.

Atomizing texts makes sense to Biblical Literalists, who take some of the smallest pieces literally, out of context, and irrefutably, and ignore others.

Earth made in Seven Days? sure! “Love thy neighbor”? not so much.

Every state with a Republican Governor, except Nevada and Idaho, does not have a health insurance exchange run entirely by the state. If the courts finally rule against subsidies for these exchanges, it will be brought home forcefully to the people of these states just how much having a Republican governor is costing them. If the Democrats can’t take over these Governors’ mansions, it will only be through massive incompetence (sadly, I’m not ruling that out).

He forgot that the original intent was for states to forfeit their Medicaid funding if they refused to set up exchanges. So buy your own Chinese takeout as well, if you don’t want to bring home any pizza.

I agree. There must be some Republicans who can see past their nose and see that they are really going to regret this this if they succeed.

You probably should start ruling it out, however.

2014 is shaping up to be particularly ugly for republicans in the various governor races. They are now underwater in FL, PA, KS, SC and running very close in OH, MI and WI. They already lost VA, but that was last year.

This ruling and all the gloating by Cruz, Boehner et. al. is going to boomerang against them. It will inflame the Dem base much more than the republican, and will shift indys and borderline republicans to the left.
