This a pretty stunning set of questions when you remember that Mueller is a brilliant prosecutor. You know he’s following Lawyer Rule #1: Never ask a question if you don’t already know the answer.

You know he’s following Lawyer Rule #1: Never ask a question if you don’t already know the answer.

There are a number of questions he doesn’t know the answer to, but knows everything around the question. Trump can give him new information if he answers truthfully, but he’s going to be screwed if he lies.

Pedantically, it’s an oversimplification to say ‘Never ask a question you don’t already know the answer to.’ I used to do it all the time. You never want to ask a question you don’t know the answer to, when the wrong answer will hurt you. There are all sorts of questions you can ask that if there’s wrongdoing, there’s not a good answer.

Pretty pointless of Giuliani the Undead to have leaked this list. There’s nothing here to undercut the SC and plenty to raise the hopes of Dump’s ill-wishers, such as myself, that an indictment is in the offing.

The conjecture on the Maddow show last night was Mueller leaked these questions because he was never going to be able to ask them personally, but if they were provided to Trump conjecture as to who did the leaking shifts to Rudy Guiliani

Yes, well, we’d all like to know the answers to these questions, and it’s comforting to think that Mueller and his team may in fact already know the answers to most of them. Nonetheless, putting these questions in the public domain may alert some journalists to the possibilities these questions pose since apparently most of them have never wondered about these things themselves. They could consider it a sort of sample SAT exam.

The rule tiowally refers to makes sense for cross-examination, particularly at trial. It’s less applicable to this situation. When interviewing a witness your principal goal is to acquire information, not build a record to support your case as best you can. No doubt Mueller also hopes to catch Trump lying and, to that end, will ask him any number of questions where the truthful answer is susceptible to proof beyond reasonable doubt. But Mueller also wants to see what Trump has to say for himself. Trump is a moron and quite likely to make damaging admissions when he could easily get away with evasions or even lies. A fair number of the leaked questions seem to be fishing for unforced errors.
