My guess is if Miller wrote it, he made some ârun headfirst into the wall argumentâ about the President as an authoritarian that has an expectation of loyalty from all who work for the executive branch. That would be incriminating.
The article also suggests that Sessions recognized the risk of the Miller letter from an obstruction of justice standpoint and commissioned Rosenstein to come up with a different argument. Rosenstein showed some pretty creative legal chops in making the argument that Comeyâs conduct in handling the Clinton matter was a solid basis for his firing. It was exactly the argument I (and many) were contemplating the weekend before the election had Hillary won.
But in recognizing the OOJ risk and choosing to placate Trump instead of arguing against it, Sessions himself got embroiled in the crime itself and made Rosenstein a witness to the crime.

When I heard that Trump had drafted a document to justify firing Comey, I was delighted. Now, at finding out that Miller helped him with it, I am positively giddy.
Trump is so ignorant, so stupid, so insane, and so atavistic that he seems to exist in a world before morality was invented. He has no real understanding of why some things are considered wrong, even if they work to your advantage. So he just blurts this stuff out, and his horrified lawyers have to clap their hands over his mouth if they can get there in time. Why wouldnât he attempt to obstruct justice? He literally doesnât understand why itâs wrong.

Miller does bring that whole Dr. Strangelove mentality with him.
Miller was also likely behind the original Muslim ban. It is clear as day that this guy has no sense at all of the law or the Constitution. Did Santa Monica High and Duke (speaking of bi-coastal elites!) teach him nothing? It is to be hoped that Gen Kelly will at some point explain to the nitwit in chief that he is more of a problem than he is worth.
