Why don’t they just demand the returns from the Commissioner of the IRS, who has the authority, and bypass “Mumbles” Mnuchin completely?

The statute says that requests from Congress are to be directed to the Secretary.

The statute also does not give the Secretary much room to negotiate – nevertheless, one awaits Mnuchin’s next move eagerly.

Rep. Neal sent his requesting letter to Charles P. Rettig, Commission, Internal Revenue Service. Mnuchin is involved because the relevant statute says the Secretary, i.e. the Secretary of the Treasury or his delegate, shall furnish the House committee with the return information it requested.

Not often a lawyer gets an opportunity to file an old school, old timey petition for mandamus. Most lawyers can go a whole career without doing it. Many might not even be aware it’s still a thing, except possibly in appellate practice. Just a thing we had to learn about in order to understand Marbury v. Madison.

But somebody will be filing one soon and then we get to see whether it gets assigned to some tendentious bad faith Trump appointee or a real judge.
