For most of us, a well-designed system of jurisprudence is like a utility. It provides something we all need like clean water, electrical power or phone service. But to the largest entities such as a listed corporation or a church, there is the temptation to rechannel that power used on it back on others for reprisal, revenge or retribution, i.e. exactly what the law is designed to prevent in dispute resolution. The Trump administration now openly threatens, as does “goes around, comes around” Kavanaugh, to use the highest court to get even with perceived enemies. If I worked for an organization, say, the Sierra Club, that butted heads with the winners in this battle, I’d be worried. In part because rules needed to protect our very existence may be needed soon (like within the next decade), or it’s game over. Similarly, legal protections such as macroprudential supervision of banks to avoid transfer of bailout costs onto the average person will now be dismantled, even as we head into the waning phase of the current business cycle.

To take Ernest Hemingway’s quote from The Sun Also Rises: “How did you go bankrupt?” "“Two ways. First gradually. Then suddenly.” I think the slow decline in democracy that the Americans have experienced goes back decades. Without an independent judiciary, the decline may accelerate.
