I’m not sure whether I prefer the actual filibuster or simple majority, but I know I prefer either to the fiction of “we’ll pretend to honor the holy and sacred filibuster unless and until we actually need to kill it in favor of a simple majority, at which instant it’s deader than yesterday’s moldy oatmeal”.

Being the stalwart defender of moderate Republican principles, Collins will withhold her support until McConnell promises her that she will get a vote on two Obamacare market stabilization bills by the end of the year.

This should put paid to the argument that Harry Reid was wrong to end the 60 vote cloture requirement for federal judicial appointments. If he hadn’t, we would practically have no liberal majority on any court in the land.

A similar dynamic applies to the question of expanding the Supreme Court. Democrats should expand the court before Republicans do it anyway. Then pass laws making further expansion extremely difficult.

We have to keep pushing the meme that no, it’s not congress that’s corrupt, it’s republicans. Because it’s going to be intensely difficult to undo a lot of this stuff while still respecting the rule of law.
