Since the GOP has signaled it will refuse to do anything, I think Obama can afford to nominate Sri Srinivasan. Normally I think it would be a mistake to take him off the critically important seat that he’s got now, since the DC Circuit rules on many cases that affect how the US government functions, but since he’ll never get confirmed, Obama can take the opportunity to emphasize to the South Asian community in the United States just how bigoted and intolerant and backward-thinking the Republican Party is.
Whether Srinivasan will be willing to go along with this is another question.

On the other hand… if the Rs take the White House and hold the Senate, the Ds will be able to argue “precedent” for filibustering any R President’s nominee, thus leaving the court at 4-4 until the next Justice dies. Better pray for the notorious RBG to hang in there. Of course, all this could lead to eliminating the filibuster all together, which would be a very good thing.
Except there are a number of critical issues that the GOP is depending on the Court to decide in their favor. So a 4-4 Court will hurt them more than help them.

Obama was a lame duck President on Inauguration Day, January 20th, 2013. McConnell's philosophy taken to its logical extension would dictate no second term President should have the power to make nominations of any kind to any position. A journalist needs to ask him that, directly, framed in that way.
This logic says on day one of a presidents second term he/she is a lame duck so if a Supreme Court justice (or perhaps any federal justice) needs to be named wait until the next president is elected by the people - by the way who elected the current president?

McConnell and the rest of the Republican establishment have reached the kamikaze stage of their defeat. Scalia’s death is a reminder that their Reagan generation is dying off during an election cycle during which even the Republican base no longer buys their ideology. Voter suppression, gerrymandering, and more judicial activism are the only resources they have left, and the message to Senate Republicans from the establishment conservatives is for them to fall on their swords and save the court for the next generation.

Just to punk the seditious GOP in the Senate, Obama should nominate someone like Robert Bork for the Supreme Court, then, when the GOP is falling all over themselves to hold a vote on him, retract the nomination and put forward a real Progressive one.
