Fascinating. So McConnell says that the American people – who twice elected Obama – should “have a voice” in the selection of Scalia’s replacement. And we can infer that when he says that the vacancy should not be filled until we have a new President, he presumably means a new Republican President. So what happens if Clinton or Sanders wins? If the Senate remains in Republican hands, will we have to wait until the next Presidential election? And exactly when does a President’s term end? Is it at the beginning of primary season? On election day? Because I’m old enough to remember when a President’s term lasted until Inauguration day…

Another missed opportunity for the GOP to improve their image. If they came across as reasonable, then perhaps it would help their candidates’ (presidential and senatorial) chances in November, and then they could get all the bat-s#it appointees they wanted next year, or during a possible GOP administration.
Their reasoning that a president with 11 mos left in a term cannot appoint someone to the highest court in the land might actually be viewed as unreasonable by the majority of the people.
Scalia’s body isn’t even cold yet, and the GOP Obstructionists are already refusing to approve ANY nomination. The GOP won’t approve of anyone Obama nominates, even if he could nominate Scalia himself.
So I propose a solution that even the GOP can’t oppose. I propose the new Supreme Court Justice should be Dead Antonin Scalia. He has already been confirmed once, he merely needs to be returned to his office after embalming. Nobody will know the difference, Scalia often slept during SCOTUS hearings.

The longest it has ever taken to confirm a Supreme Court nominee is 125 days. Obama has 342 days left in office. So even if they took literally twice the amount of time than the longest confirmation of a nominee, it can be easily done while President Obama is on office. Obama will make a speech and announce a nominee - What are you going to do about it Mitch? try to get the Supreme Court to issue a gag order on Obama? An injunction against Obama performing his duty?
