I’m wondering if the prosecution has moved for a mistrial?

Ellis has badly mishandled this case. Behavior I suspect he’s gotten away with for years without any scruitney.

The Federal judiciary takes this stuff seriously. Locally a Federal judge who behaved similarly was forced to retire. Not senior status, but retire.

I’d bet you a bottle of wine, the Chief judge has already spoken to Ellis about his behavior and is pushing him to stop.

No matter how this comes out, this is Ellis last trial.

Back in court and Judge Ellis says: “Mr. Andres, you may call your next witness.”

Andres reminds him the jury still needed to come in.

Reported that the courtroom erupted in laughter…but Ellis really isn’t up to the job!

I’m not predicting a mistrial, but won’t be shocked by one. I think the chances of getting one Trumpian Kool-Aid consumer on that jury are strong.

Whatever had happened all morning left the Judge rattled.

From the Washington Post:

“All right Mr. Andres, you can call your next witness,” Ellis said returning to the bench without any discussion of what the side conferences were about.

“The jury, your honor?” Andres asked, sparking laughter in the courtroom before the jury filed in to take their seats.

Based on his comments in front of the jury, which were highly prejudicial. If he calms down and slows his mouth and behaves through the rest of the trial, I think it’ll be fine though. I think he has been doing a little damage control at this point and is hopefully now going to be highly sensitive to the issue.

Just like how he plans to suspend black NFL national anthem protesters without pay. Not having ownership of any team is just a minor technicality.

They’re arguing some motions. Speculating that those include what we know about (judge mia culpa to the jury, additional evidence etc.) and this includes at least threats of a motion for mistrial. I’m speculating the chief judge of NDVA (not the chief justice) has already spoken privately to Ellis about his behavior and the ramifications.

A motion for mistrial based upon the judges behavior during trial is something that would really freak any judge out because of the personal embarrassment and perhaps even forced retirement. A mistrial represents hundreds of thousands of dollars in wasted lawyer time for the Government and the defendant.

All this would explain the long delay and the judges sudden sheepishness re his own behavior.
