Good. Glad justice was served on this douchebag. Just curious though, how is this not double jeopardy? Anyone? Since the article says,

It was second time Rodriguez was convicted of murder for the 2010 slaying. He served two years of a 40-year term when a Texas appeals court overturned his 2012 conviction.

Thanks for the 'splainer. Maybe AP has it wrong. Wouldn’t be the first time, that’s for sure.

I believe it depends on the grounds on which the conviction is overturned. If the conviction is overturned on a technicality then the prosecution can retry the defendant if they chose to do so. My understanding is also that double jeopardy only really applies when the person is acquitted.

quibble: This may or may not have been the original AP story. TPM might have modified it to keep it within word length or something. Hard to say. the sausage has to get made somehow.

The original conviction in this case was when a jury didn’t buy his 2012 “stand your ground” defense in the killing of a neighbor. But the appeals court bought his attorneys’ argument that the jury instructions (on what juries were allowed to apply to confusing stand your ground defenses) were unintelligible, so ordered a new trial.

“Rodriguez and the State agree that the trial court’s charge included erroneous
instructions regarding a qualification on self-defense, but they
disagree about whether reversal is warranted. We conclude that it is,
and we reverse and remand a new trial.”
