Was not someone who claims to be “America’s Mayor” the prosecutor during this time…I’m guessing that he with the help of his bestie Bernie Kirik, worked the scam to pad his conviction numbers…

I spit on the ground at the mention of Giuliani’s name, but he was the U.S. Attorney, not the county D.A. who prosecuted this case. U.S. attorney has jurisdiction to prosecute federal crimes. This was a state crime.

During Rosario’s appeal, a judge said additional alibi witnesses wouldn’t have added significantly to his defense.

Oh, go fuck yourself, your honor; I swear the standard of finding error in a criminal trial on appeal needs to be much lower than it is.

IIRC it used to be, but then the Supremes stepped in and decided that only errors that could be shown to have a substantial impact on the case were reversable. Because following the constitution costs too much.
So unless you can essentially prove that a jury would have found you not guilty except for the police/prosecution misbehavior, tough luck.

Which means that police and prosecutors have very little incentive to behave within the law. If violating someone’s constutional rights gave them a free pass for that particular crime, law enforcement would be more careful. (In my youth I thought that the late, lamented exclusionary rule should be modified with an option where the prosecution could use the evidence as long as either a prosecutor or a police officer pled to the crime involved in gathering it and served a nonsuspended sentence. Yeah, right.)

On the bright side someone got away with murder…oh wait…
