This piece from the NYT has more quotes from Davis that make absolutely clear she is allowing her clerks to issues licenses she believes are invalid. That belief itself–regardless of its ultimate legal merit–casts doubt on the validity of the licenses and strikes at the very heart of a system based on laws.
Well somebody has to hire them…and outside of wingnut welfare, that ain’t happening.

I’m sorry, but wrong. Her assertion is stupid and wrong. The judge is merely giving her the rope to hang herself with.
Not a huge loss at all. She’s already backed way down, and I imagine the voters are going to toss her next election.
Seems like a pretty good solution: Davis gets to say she doesn’t believe the licenses are valid, while VALID licenses continue to be issued. Her belief on the matter is irrelevant. I wish the legislature had the guts to impeach her. The new lawsuit is another loser, just like Kim Davis.

There is no ambiguity at all. Her original signature is NOT required.
KY Statute 402.100(1)© provides that each license shall have a space for “The date and place the license is issued, and the signature of the county clerk or deputy clerk issuing the license.”
Thus, per the applicable statute, deputy clerks can sign.
Relax. This is exactly what Judge Bunning told her lawyers to do. He ruled on Saturday, rejecting her lawsuit against the Governor. He stated those claims involved State law issues, and thus his Federal Court was an improper venue. He said her State law claims should be brought in State Court.
I am assuming this “new and improved” lawsuit will be brought in State Court…

I hope the court threatens more jail time for frivolous lawsuits. Including for the attorneys. Extra time for the attorneys for practicing without a brain.
She hasn’t backed down a bit. She’s now messing with everything to perpetuate the legal claims that can be made about these licenses. She actively removed her name and authorization from the licenses and is setting up lawsuits challenging their validity.
As for giving her rope, that’s my freekin point. Her activities should already be considered to have hanged herself. The fact that she isn’t now back in jail for having removed her name and authorization from everything all while running around publicly claiming the licenses now have serious validity issues as a result, which is an admission that even she acknowledges her behavior is an interference with the licenses and therefore violates the judge’s orders, is why this is a win. She’s being given carte blanche to mess with the process as much as she wants so long as someone at the counter is pushing paper that says “marriage license,” even though what she is doing is further making a mess of everything in service of her own personal, idiosyncratic religious beliefs. She belongs in jail for ALREADY having violated the judge’s prohibition of interference. It’s not even remotely debatable. He gave her the rope indeed…which is part of why I said above that I understood why he did it…but if he fails to pull it tight now that she’s got it around her neck, then the whole exercise was moot.

The argument will be that they can only do so when authorized by their superior clerk. Yes, they can sign when authorized. Moreover, she has apparently altered the form, which can sometimes cause more problems. The point, however, is not whether she is correct. It is whether she has acted in a way that is deliberately creating new legal issues and lawsuits to prolong the resolution of this matter and deny these people their rights and subject them to challenges to the validity of their marriage. She is acting that way, whether she’s right about its effectiveness or not. THAT is what should land her back in jail tonight.
Not here really. Assent can’t be found in obeying an order. Moreover, all she has said is that she’s allowing them to go through the motions, because she believes that without her name on everything (after she removed it) and her authorization to issue the licenses, they remain invalid, i.e., it’s not a violation of her religious beliefs because she thinks all she’s letting them do is “make pretend.”
Since she is trying to have it both ways, she really is not sincerely acting on her consciously held beliefs. Put those beliefs and her job in the balance, she would have to resign. She cannot dictate the terms of her job. The judge must be livid.
I kind of got the impression from the Judge’s order that the hirsute hillbilly Joan of Arc wasn’t quite compos in the old mentis and, perhaps, her license decoupage will be treated accordingly with newly minted married couples gaining a valuable collectible with their Kim-modified but still valid license.
