Kennedy’s order concerning Idaho was a mistake, too----he just hasn’t figured it out yet.
Sounds like Kennedy needs better clerks—or retirement.

The Idaho case had the governor (wife’s name really is “Gay Otter”) and AG asking for an en banc hearing… it’s pro-forma to allow for a temporary stay until that matter is cleared up. Frustrating, but part of the kabuki dance.
In the case of Nevada, neither the gov nor the AG were pursuing an appeal, but this “mistake” allowed a third party to potentially intervene…
I’m betting that Kennedy will let the full 9th refuse the en banc hearing and then close the matter and slap down the Nevada intervention by the weekend.

Easy response: the anti-gay marriage group has no standing. This was already decided in the Prop H8 case.
Yep. This is just crossing all the t’s and dotting all the i’s.
Edit: considering all of Kennedy’s boo-boos in this matter, it may be dotting the t’s and crossing the i’s.

Gay Otter was his previous wife.
He current wife is a much newer model, young enough to be his daughter.

Marriage should be between one man and one woman. Then the man can dump the woman and get a much younger one. Or in the case of Newt Gingrich or Rush Limbaugh, a series of much younger ones. We cant have gays destroying the sanctity of marriage, you know.

I think it’s time for Kennedy, Scalia and Bader-Ginsberg to retire. Maybe we should be like the Vatican and mandate retirement for Justices when they reach a certain age.

They can ask for an en banc hearing—but the 9th circuit is under no circumstances required to grant that request.
If the request is denied, the 3-judge panel’s ruling stands, and only the Supremes could change it.
Given their denial of cert to the other appeals, this one would not make to SCOTUS either.

Governor Otter’s wife is a former beauty queen named Lori. We should get the go ahead for marriages here by tomorrow or early next week according to the folks at the SCOTUS blog.
Kennedy’s order was a clerical error that the justice corrected with a second order several hours later.
TPM buried the lead:
Kennedy’s order came … when IDAHO filed an emergency request for an immediate stay to prevent the Supreme Court from having the last word on whether same-sex marriage would occur in IDAHO.

I am starting to think that Kennedy actually passed away 4 years ago so Scalia and Roberts tied their shoelaces together and have been propping him up and voting for him since then, Weekend at Bernie’s style.
