Discussion for article #223179
So now tea partiers are exempt from the death penalty? Figures on a Roberts’ court.
This article doesn’t say which justices ruled on each side.
Edit: Never mind. I found the opinion elsewhere. Wow. We are one Anthony Kennedy away from being the biggest asshole country in the world. Stay classy, conservatives.
OK, do we all have to engage in the research?
Odd considering high court Justices with IQ’s around 75 do not speak from the bench…
I found it at SCOTUSblog. Here is a direct link:
http://www.supremecourt.gov/opinions/13pdf/12-10882_4f15.pdf
KENNEDY, J., delivered the opinion of the Court, in which GINSBURG, BREYER, SOTOMAYOR, and KAGAN, JJ., joined. ALITO, J., filed a dissent- ing opinion, in which ROBERTS, C. J., and SCALIA and THOMAS, JJ., joined.
For those who actually work for a living and don’t want to take the time to research the opinion in Hall v. Forida…

Panda, I agree with you this should have been part of the TPM story. Maybe it was written by a new intern.
Haha. Well, don’t blame TPM. It’s an AP article. But yeah, it could at least contain the name of the case.
So, this has to do with TPM trolls, right?
When is a corporation going to be executed?
Some states just really really really want to execute people.
Hence the picture of two men who represent the new face of mental retardation,… er, excuse me, of developmental disablility…
So, the current radright cabal on the Supreme Court is just one breath away from getting to execute people with intellectual disabilities.
God help America!!
Do they not hear themselves? Do they not see how ridiculous all of this is? IQ tests, mystery drugs, bringing back the electric chair…for God’s sake, just GET RID OF THE DEATH PENALTY! Quit tinkering with the machinery of death.
Cops, detectives, attorneys, DAs, judges, juries: all of them are under tremendous pressure to convict convict convict. When are we ever going to realize that the death penalty is simply too much trouble?
I do think Supreme Court Justices should have to pass an IQ test. If they don’t score AT LEAST 140, they should be withdrawn as a candidate. I would say the bar for legislators should be at least 130. If that were true there would be a whole lot of sudden vacancies both in Congress and on the Supreme Court.
You would think that would be a standard piece of information to include in the article - how each justice ruled.
What’s the break down on the vote? The 4 pro-death justices vs. Kennedy + the sane?
On edit: Yep. Just as I figured.
what about people in a coma? what if they had done the crime but fell ill - or were injured … isn’t there a right to retribution there too?
How long before some genius tries to use this case to get the death for a convict with an IQ of 65? … arguing that 65 is within the margin of error.
Well, it is an AO story after all, so magic eight-ball points to “yes”.
