When you listen to the statements coming out of the WH, it’s pretty clear this promised new order is now about 2 weeks overdue. First, they suggested to reporters a new order would be coming within days of the Ninth Circuit ruling, then ‘next week’ which was last week.

Here we are on Friday without this magical new order and they are worried about a deadline next Friday.

They already knew outright discrimination based upon religion wouldn’t work so they thought they were being cute. Now, they have learned that Congress many years ago expressly banned discrimination based upon national origin.

Being a bigot in 2017 is so hard. My guess is we’ll never see this order and they’ll move to Congress and try to amend the Immigration and Naturalization Act. That will take months at least and likely will never happen.

But don’t you remember? Trump said the “We will win in the courts!” and vowed to overturn the injunction which so severely “threatened the security of our country.” . . . . Yeah, right!

So just what is it the DoJ wants in a procedural sense? I guess they don’t want to lose the case officially, because that would make it harder to implement another EO saying essentially the same thing. But it also sounds a lot as if they’re just withdrawing their appeal and not admitting it.

Which is going to lose another case if that’s what they do - he cannot get what he wants legally. He’s stymied.

I think they’re trying to get something that won’t run out (remember, the EO can only last 90 days anyway, maybe 120) before they get gorsuch on the court. Because they think he would rule in favor. (Citing Korematsu as precedent, no doubt.)

If they do it’s lousy precedent to cite.

We were at war with Japan. We aren’t at war with the countries he’s seeking to ban.

We can’t afford to be at war with the media. We need them and Trump is at war with them, which works for us. We need to be on the side of the free press, even when we don’t agree with it.
