I hope 4 members of the Supreme Court walk out the first Monday of October

They might as well, as if they will have any say, with the other 5 making up a majority.

It’s the right choice. Do not confer upon this process even a veneer of legitimacy.

It’s probably about time for another Civil War. Goddamn Lincoln should have razed the South and salted the earth when he had the chance. This isn’t getting fixed via normal legislative, judicial and executive branch means. Our government wasn’t designed to deal with a party controlling all three branches of government that was OK with rampant criminality in their ranks, foreign governments having a say in our elections, and a sizable portion of the populace having to climb multiple onerous hurdles to cast a ballot. Personally I think we’re cooked.

We’re only cooked with attitudes like that. I’m not giving up. We’re going to have to fight better and smarter. That pendulum is on a return trip.

Democracy is the best weapon we have against this rampant criminality.

In November we can vote all of these old angry white men out of office in such numbers that no amount of gerrymandering, voter suppression, dark money, and foreign colluding can withstand. We can…and we will.

Sure. Then Republicans will figure out all the leaks in the dam that allowed Democrats to prevail, and task SCOTUS with plugging them. Which they’ll dutifully do.

Has Tierney begun using FoxMath™?

Wow. What would happen? Can the Supreme Court make a ruling without all the justices, assuming they haven’t recused themselves?

ETA I’m trying to find an answer. Will report back if I hear anything.

Booker stayed. Whitehouse left. Keep an eye on both of them because that’s definitely interesting.

Yes they can. If it ends up tied 4-4, then the lower court ruling stays in place.

Disappointing.

That’s not the question. The question is what happens if they refuse to participate.

Please see my edited post above.

Thanks, I’d like to know that too and Nina should know it.

Walking out is easy. That’s why it’s so surprising Whitehouse did. Booker and Whitehouse are the two most controlled and calculating members of the Committee other than Feinstein. Walking out would not be in character for either of them. But it would be less surprising for Booker to make that statement.

Maybe they left and came back because Leahy gave an impassioned statement and Whitehouse was on fire. I’m not sure silencing yourself is really the best strategy.

Agree. Booker took the hardest route, and the most principled. That’s why it’s so surprising to see Whitehouse doing this:

Yes. That’s what happened.
