Discussion: Judicial Stand-Ins Block Impeached West Virginia Justice's Trial

Can’t they just change the rules? it’s worked so well in the past

This is getting to be a lot of fun. If the impeachment proceedings are constitutionally unsupportable, then the “stand-in” justice who’s acting in place of Workman shouldn’t be doing so. Which means that this ruling is invalid. Which means…

The judges previously hired to impeach the judges have been impeached. The trial will now continue at great expense.

Something parallel to that.

So what are the party affiliations of the judges who have thus far been let off the hook?

If SCOTUS gets involved it would be a travesty akin to Bush v. Gore. From what I can tell, this is an argument solely about the State Constitution and state regulations. Other than saying the decision is wrong, I’m not seeing much in the way of substantive argument about why the high court should step in and the grounds for it to do so. Of course that was true in Bush v. Gore, but that case is a one-off accrdoing to some of the justices who sat on it and I believe it is rarely cited as authority in subsequent court decisions. Of course, the newly constituted court could always choose to get embroiled just to give a taste of how they may act in the future.

Remind me again which state gave Trump his highest margin of victory.

Virginia just called. They want to make it very clear that reunification is not an option.

Am I crazy or would the SC getting involved allow them to say that the SC should have a say in the courts of all states. The SC would be able to say who can stay and who can go based on the whims of those states’ legislatures. Is this a SC power grab??
