I think that Trump will print the census, with the citizenship question on the last page.

Meanwhile, Ross will go through the ā€œproperā€ procedure to get the question on the census.

Someone will file an injunction, demanding that the printing be stopped

Trump will argue that if the issue is not resolved in a timely fashion, the question will not be asked, and the last page will be trashed.

And because the only ā€œirreparable harmā€ would result if the courts found on Trumpā€™s behalf, printing will continue with the question.

If the District Court judges who have these cases choose to slow-walk them and not render decisions until, say, Halloweā€™en, theresā€™s nothing the maladminisration of the Supremes can do about that.

Can they pluck it back regardless, or can the Administration make some other pre-judicial appeal (or whatever it would be called)?

Serious question, actually, not sure all the rules on this sort of thing when it gets punted like this. Normal order clearly is to wait for things to flow like normal, with a new ruling, appeals, etc., not sure how that plays out here.

Iā€™d say it was closer to Feb 1 or as late as mid-March.

As I noted above, the courts would probably allow Trump to prepare to have the question asked, as long as he had a plan that would take the question out of the census entirely.

All the training, programming, etc etc could be done in a way that makes it possible to not ask the question. And since its easier to delete a question at the last minute than to add one, the ā€œirreparable harmā€ argument in court goes to Trump.

This is going to be wery intervesting.

How long do the ā€˜correctā€™ procedures to place a question on that ballot typically take. I love it that now they are saying O yeah, we can wait until late October when before they asked to skip intermediate steps because it absolutely had to be decided now. Some of the Supremes have some mud on their faces, but they probably donā€™t notice. The problem those in the WH may have is explaining to the idiot in Chief that depressing the votes of minorities and non-Republicans is not usually considered a good reason ā€“ although it seems that four of the justices might buy into that rationale.
I would like to see this case go forward with full discovery and airing of the lies and misrepresentations. The WH and Ross and company lied to the courts. They should be penalized in some manner for doing that, including refusing to reconsider any later excuses for the question present by the WH etc. Unless the court proceeds, however, that information and a basic record may not be made. I hope the judge goes ahead with the hearing. The information must be preserved, even if the Government folds; he should still investigate contempt of court.

Why would you trust their answer on continuing to fight for this question? Is the judge going to stop the case if they say ā€œsure weā€™ll stop hereā€? What am I not getting with this question? What stops them from lying about not going forward and then going forward?
