The AP’s being cute by signaling acknowledgment that the claim they feel compelled to report is ridiculous. Still, if the cops had said that they had repeatedly and firmly implanted a command to drop the gun into Tamir’s brain Using Only the Power of Their Minds before they had even arrived on the scene, the AP would report it.
I have to admit, I thought they were intentionally stalling this ruling until after the NBA Finals and that the cop was not going to be charged.
Very pleasantly surprised here.

Legally means nothing. Puts pressure on the D.A., but doesn’t force the issue.
Yes, the gun looks real, but that is of no relevance. Protocol in that situation is not to go screaming up to an alleged gunman and put yourself and your partner in jeopardy. You pull up 50 feet away or so, get out and crouch behind the door, point the gun and say “drop the weapon”. What they did was asinine, and more importantly, against proper procedure.
So even if this WERE a real gunman situation, they blew it procedure wise. And since them “blowing it” caused a death, criminal charges should definitely happen. Murder charge not likely, but at least a negligent homicide.
And is that an old photo? This being ruled a “homicide” is not a “New Development”, that was known almost immediately. The “new Development” is that a judge says it was a criminal homicide, and that charges are in order.
Hmmm. That, unfortunately, seems to be the case. Read the same thing in the NYT just now.
This week, a group of activists and community leaders asked the Municipal Court to have the officers, Timothy Loehmann and Frank Garmback, arrested under a little-used Ohio law that allows “a private citizen having knowledge of the facts” to start the process by filing an affidavit with a court. They argued that the widely seen video of an officer killing Tamir had given nearly everyone “knowledge of the facts.”
On Thursday, Judge Ronald B. Adrine issued an order saying that probable cause existed to charge the officers, and “this court determines that complaints should be filed by the prosecutor of the City of Cleveland and/or the Cuyahoga County prosecutor.” What weight the order carries with the prosecutors is unclear.
Tamir was seen pacing, occasionally extending his right arm with what appeared to be a gun in his hand, talking on a cellphone and sitting at a picnic table with his head resting on his arms.
There are serious questions that are not getting answered in this case. How can the police roll up on someone in an Open Carry state and kill them for having a gun? Yes, the same question that didn’t get answered after John Crawford was killed in WalMart. Why didn’t the police bother to establish what Rice was doing before they shot? How are they still walking around after being caught in some serious lies? Why are they still on the job after filing false reports? Why hasn’t either the state or county done something?
Local, County and State government should be embarrassed by the family’s action, and the court’s decision.
I talk pretty damn fast and still it took over two seconds to say “drop the weapon, drop the weapon, drop the weapon.”
But here’s the thing that gets me. Ohio is an open carry state. Even if they thought he was an adult (apparently, all black kids look like grown adults), they had no way of knowing he wasn’t well within his rights to carry a gun. They just as easily could’ve shot a citizen merely out exercising his 2nd Amendment rights. I’m sure the NRA will be all over this any minute now. I’m sure Wayne LaPierre will be holding a press conference…Any minute now…

?? What a dumb statement. Nothing wrong with police officers reacting quickly, that’s their job. The problem was they acted wrongly, and it caused a death. Even if what they say is true that Rice was grabbing the gun in a manner to get ready to shoot (and I seriously doubt that), they never should have been that close to him. They screwed up and created a dangerous situation for ALL parties. Completely against the book behavior.

Something wrong there don’t you think? I don’t care if you speak faster than an auctioneer or a guy doing the disclosures on a car ad…you cannot ask anyone to do anything 3 times in 2 seconds. It wasn’t a “few moments” it was 2 seconds…watch the vid. They drive right up to the kid and shoot. But then leave him there without medical care and when his sister tries to help him they beat the shit out of her. They just let a kid lay liay there after they can see they shot a kid with a toy.
At some point we have to stop allowing Cop’s the right to fuck up and kill. To be wrong and kill. To kill when a thousand other options were available.
Not to mince too many words…I think what the author meant to say was the video shows the officers “acted too quickly” which would be wrongly.
It would be somewhat excusable if it was the author, it was the families attorney’s who released that statement (it’s in quotes). Definitely a poor choice of words for attorneys.
Even if Loehmann could speak that fast, why would he? Why would he say “put your hands up” three times in two seconds? Realistically, an officer would say the phrase once, wait a short time to see if he obtained compliance, and then say it again. Did Loehmann have some strange speech impediment akin to stuttering that would make him repeat statements in threes? It makes no sense.
Then why bring it up?
Does the DA want to piss off the police when they feed him the cases he prosecutes? Police have recently shown in Baltimore that they refuse to do their jobs when their fee-fees are hurt.
Here’s a story about the deference that white folks get from from the police.
“Sovereign citizen” stopped for speeding is asked calmly and politely for ID 15 times before the cop busts his window and drags him out of his car.

You can’t say “Stop, hands up” or just about any statement one could think of in 2 seconds.
This is just a couple of cops who thought today we can kill and since we are cops we’ll get away with it, and who the fuck cares about a N(clang) anyway.
How about the Biblical punishment, you know, An Eye for an Eye. So give each of them a chance to stop, drop a toy from their hands or be shoot, all within 2 seconds. Bet they can’t do it even knowing what is coming if they fail.
