That portion of the law provides that if a potential voter doesn’t have the proper photo ID, two poll officials can personally confirm their identity in an affidavit.

Now how in the hell is that going to be possible when they all look alike?

They Can appeal to the 11th Circuit, though. A Circuit that has 11 active members. Of those 11, 5 nominated by President Obama and 3 nominated by President Clinton.

This is the Judicial equivalent of “passing the buck”.
He doesn’t want to rule on this so he “punts” to force it up the ladder to the Circuit Court of Appeals.

Very very cute. He’s trying to create a “you lose” loop of circular logic:

  1. You bring a claim that these ridiculous proof of citizenship requirements are overly burdensome and have a disparate impact on minorities.

  2. Conservative judge tells you to prove you have standing to even bring the claim, and that you must therefore prove you are a citizen eligible to vote.

  3. Once you prove you are a citizen eligible to vote, the conservative judge smiles at you and says “see, that wasn’t so hard, but I’m sorry, you do not have standing because you are not damaged or at risk of your rights being infringed. You have proof of your citizenship and can therefore easily get your ID and vote, so you are not at any personal risk of being told you cannot vote.”

The “tell” is right there on the first page: he has specifically adopted the political argument of the GOP/Teatrolls that a fraudulent vote infringes on a valid voter’s right to have their vote counted." It does not. That is not a legal principle and there is nowhere in the case law that such a principle is adopted. 1 fraudulent vote in a sea of legitimate votes casts no aspersions on anyone’s asparagus…nor does it cast aspersions on everyone’s asparagus by whatever pro rata share of the aspersion each person’s asparagus suffers. It is such an infinitesimal, de minimis occurrence as to have functionally zero meaning.

There’s a reason a guy born in fucking Nantucket goes to U of Alabama for both undergrad and law school and then stays down there. I’ll leave you to do that math.

What is going to happen is that a lot of widows will be denied the right to vote because their ID’s don’t match because of names changes when they married. The white widows will be personally confirmed by voting officials, the non white widows will not be personally confirmed.

He’s concerned about that one voter whose vote gets “cancelled” by an imaginary fraudulent vote being cast, but doesn’t give a shit about all the legitimate voters whose votes could be not just cancelled, but prevented from even being cast, by an arbitrary, subjective process that is clearly subject to rampant abuse? Judge Racist should be impeached. This decision seems to me to cross the line.

Make no mistake: the red candidate is getting Alabama’s electoral votes. This is about their universal effort to make it so a blue candidate that wins might do so with a minority of the votes nationally, so they will have their excuse to go full-bore on the electoral votes system. It will also help them spend for years yelling about revolution while pretending the duly elected POTUS is a fraud and has no mandate or electoral legitimacy.
