To be fair, this is civil contempt, which rarely ever results in arrests or incarcerations. He does belong in jail though. That securities crap is ridiculous.

It is obvious that they should amend the death certificate because it is the right thing to do. It is also almost certainly the correct legal result, but this story doesn’t actually give us enough information to know that. I had to do some digging elsewhere to figure out what was going on here.
The reason Paxton is wrong on the law is because these guys were legally married in another state (New Mexico) and so the issue is just a matter of Texas recognizing that marriage on a death certificate. Calling this a retroactivity issue is a frivolous argument, maybe even contempt-worthy.
That said, it is not quite right that constitutional rights are automatically “retroactive” or vest once the Supreme Court issues a decision. From the looks of the TPM story, it appeared that these guys tried to get married in Texas, were denied that right, and are now looking to amend a death certificate without ever having obtained a marriage certificate. If those had been the facts, then I think Paxton would have been right on the law (though wrong morally), since Supreme Court decisions don’t solemnize marriages – that’s not how U.S. law works.
So to make a long story short, TPM should have given more background info. for us to know exactly how big an asshole Paxton was.
Rights are not retroactive or not - they just are. This jackass has no business being the state’s AG.

I’m still surprised how it’s a state law that public school children are to be subjected to daily indoctrination in the pledge of allegiance “To the United States of America and to the Republic For Which It Stands.” Seriously? Who the fuck wrote that law? Has that person not heard from the secessionists?
Don’t just order him to appear in court, put his ass in jail for a few weeks while his criminal actions come up behind all the other criminals who wait in jail for their day in court, first - in, first - out. Let him languish in jail waiting for his day in court, behind all the black and Latino people waiting in jail for their day in court for a minor traffic violation.
I think they only disbar attorneys if they get caught stealing from their clients, but leave the client enough money to hire an even more expensive attorney to go after the first one.
