On the FL legislation part of the article, I’m so sick of hearing about half-measures in a vain attempt to slam the barn door after the cows are already out. “What could we have done to stop this last shooting from happening again?” Let’s raise the age limit or some other such nonsense.

The only way to stop mass gun murders is to make guns so much harder to get and to hold. Regulate the living crap out of them and let the public bask in the freedom from fear of a gun massacre. Problem solved. Instead, stupid extreme ideas in the other direction always get a full airing, like arming teachers or more security or more mental health commitments which just discard the person to get them out of sight.

I’d say that anyone who WANTS an assault rifle (except to keep at a registered and regulated gun range) is mentally ill and should be allowed to have one. I’d say anyone who wants a handgun ‘for protection’ is stupid and their judgment can’t be trusted to have one. Somehow, the most of the rest of the civilized world has realized this and gotten control of guns.

Who is going to pay these lawyers? Most common reason to bail.

I don’t know what, if any, prejudices toward the prosecution this judge may have.
i know two defense attorneys and a retired judge and they tell me these judges who are brazenly prejudicial on the side of the prosecution are hurting their own cause by creating causes for appeals.
The competent judges are totally impartial in court, display no leanings.
That insures a trial more likely to be seen as fair no matter how heinous the crime.

It’s not the lawyers who want to bail. They want the judge to recuse herself from the case because of her previous rulings and comments. Admittedly, it’s difficult to grasp this from the headline. TPM headlines have a way of being like that.

You’ve run into that most impressive of situations, the Catch-22 of gun rights (at least according to certain interpretations of the 2nd Amendment):

If they were sane, some say they have a right to own an assault rifle, but the desire to want to own an assault rifle is insane, so they shouldn’t be allowed to own one. It’s too bad this isn’t the default interpretation of most decision-makers on this issue.

It’s a ritualized kabuki dance, nothing more. They go through these motions, knowing perfectly well they won’t actually pass anything.

Two points. The “right to self protection” was created out of thin air by none other than Constitutionalist orginalist Anton Scalia. There is no mention of such a right, or any an inference of any such right. Secondly, if guns actually protected people and households, then people buying guns would see their insurance rates drop. They don’t Instead they go up. Because the actuaries have determined that guns are more likely go shoot someone in the house than any intruder, therefore are a higher risk.

As a caveat to the second point, South Dakota passed legislation in the wake of Newton to arm teachers. It has not been implemented. The reason? Because not a single insurance company in America will issue them the liability policies that would be required. Because it INCREASES the liability, not decrease it.

That is a problem with headlines here. I, too, thought the attorneys were trying to get out of representing him until I read the article.

Liability, schmiability. It’s liberty that matters. The tree must be watered, and we volunteer your kids to have the great honor of doing so.

Yeah, looking at today’s headlines, it took me a while to figure out why the US was sending an envoy to a North Korean’s retirement.
