This brings up a really good point. How many cases of people who are eligible to vote are turned away, because of mistakes made in the voter lists, ill-informed poll workers (almost happened to me), too few ballots printed, being directed to the wrong polling place or being turned away. It sure as hell is a lot more than 5. How many people associated with those offenses have been prosecuted?

Plus, how many millions of voters are defrauded my gerrymandering? Their votes are definitely diluted.
Is this a judge tried case or a jury tried case? It sounds like it is a judge tried case, which explains her helping the hapless Kansas lawyers. She doesn’t want them to have any odd ball basis for appeal. Judges generally keep their mouths shut when there is a jury, but don’t have any problem asking questions when they are the trier of fact.

As is typical for right wing ideologues (including the folks who do studies for Cato and Heritage), the goal you want to achieve drives the arguments and evidence you use to get there. The “garbage out” they want to see determines both the garbage that goes in and the way that it gets processed.
