Judge Furman will note in his opinion how Ross claimed he did not have time to answer questions, but then sat for interviews (which were NOT under oath) and will note that his refusal to testify about his misleading statements is evidence that he had nothing helpful to say, and his lack of testimony when he could have testified, is strong evidence that his statements are lies, and the claims he made pretext…

You can’t make these assumptions in a criminal case, but you sure as hell can in a civil case…
