Now that’s rich. Let’s set aside the laws and social mores that address recusal (I’m a commercial litigator and a former law clerk, so I know a little about that
) - this is oddly honest of Jindal. He is advocating that no person should be able to be a judge or justice, a priori, if they disagree with his political biases. Attitudes like this are reasons why even excellent conservative judges (e.g. Richard Posner) never make it up to SCOTUS: they aren’t ideological hacks and are unpredictable. Republicans made that mistake with Souter and they’ll never make it again.

Of course, conservatives NEVER do this - it’s not like they have a decades-long mission to do exactly this or anything.

Scalia should recuse himself from the case based upon the fact that his son is a Roman Catholic priest.

I’m pretty sure we can find reasons to have Thomas, Alito and Roberts recuse themselves
oh wait, aren’t Alito and Roberts Roman Catholic also? And don’t they seemingly adore kowtowing to Rome?

Did Thomas recuse himself in Bush v. Gore while his wife was reviewing the résumés of applicants who wanted to work in a potential Bush administration? No. Did Scalia recuse himself in Bush v. Gore while his son was employed at the same law firm as Theodore Olson, who was arguing for Bush? No.

On the other hand, Rehnquist did recuse himself in United States v. Nixon because he had worked in the Nixon Justice Department.

You know, if being elected President were something like making the world’s largest rubber-band ball, in that the only thing that mattered was how badly you wanted it, Jindal might have a shot. But when you spend every waking minute and, for all I know, many of your sleeping ones groveling in the mud, trying to win the affections of the dumbest fifth of the country, it’s gotta hurt you for the general. You’d think a Rhodes Scholar would figure that out eventually. Puzzling.

 its only fair


perhaps they should also recuse themselves from any issue having to do with women’s rights, such as abortion or employer mandated insurance for contraceptives, because after all
 they’re MEN and what do they know about women’s issue?

Current Scotus is 6 catholics and 3 jews. Love to hear Richard Nixon’s thoughts on this.

But yeah, they should recuse themselves, just like Clarence Thomas recused himself from affirmative action cases cuz he benefitted from it. And recused himself from Vance vs Ball State cuz he was a harasser himself. Oh wait a minute
