But itā€™s a convenient fig leaf to prevent any suits for wrongful imprisonment. And possibly difficult to argue against depending on the availability of evidence in the case. So ugh, but at least sheā€™s out of prison.

Cases like this one are why we need Trump as President. Heā€™ll lock up all women within an hour of taking office.

She had a miscarriage. Whatever the cause of it, thatā€™s what occurred. Thatā€™s whatā€™s being termed a child for the sake of this statue. She now has a felony conviction on her record. Iā€™m glad sheā€™s out of prison and all, but she should damn well have both convictions vacated.

I agree. Unfortunately, the original conviction (as far as I know) operates as a juryā€™s finding of fact that prosecutionā€™s allegations were correct, and the appeals court is stuck with that ā€œfactualā€ record.

In a better United States, she would have had an opportunity to see the doctor of her choice in complete confidentiality and terminate the pregnancy in a safe manner. Instead, she spent several years in prison for a self-inflicted abortion due to a very poorly applied law.

Not sure what you mean here. They said that the law was applied incorrectly. Reading the neglect statute, it applies to children, not a miscarried birth. Iā€™m not sure what they think she was reasonably able to do with a 25 week premature birth at a home setting.

ETA: And she claims that she believed she was 10-12 weeks pregnant. Thereā€™s nothing she could have done with a premature birth at that level of development, even had she not been attempting to induce a miscarriage.

Well, my kid read about this story on the internet, and was somewhat upsetā€“child endangerment, I say! So thereā€™s another charge to pile on, Indiana.

This happened because the PRO-LIFE Dr that found the babys body in the dumpster said that the baby was breathing . If it had been another Dr they would have found it was NOT breathing .

No way! That will just encourage other women to have miscarriages!
