Discussion: In Supreme Court, An Unprecedented Clash Over Race

Discussion for article #221917

It has everything to do with the fact that Roberts is a complete tool, and and Sotomayor is rightfully calling him out.

"Roberts’ the 'way to stop discrimination' quote has become not just a jurisprudential meme but a public one. Sotomayor has provided a response. For Roberts it is race-consciousness that is racism; for Sotomayor racism is reality and history."

Nailed it. For Roberts, this shit is theoretical (assuming he’s not just being disingenuous); for Sotomayor, this is the real deal, and – unlike Thomas – has no problem calling these assclowns out. If anything, this was a William O. Douglas moment for her, and she may be Obama’s biggest legacy.

A bunch old white men and a self loathing Tom lecturing a bootstraps Latina about the brown eyed world. Egads, priceless.

“In my colleagues’ view, examining the racial impact of legislation only perpetuates racial discrimination.”

This is the absolute nub of the issue. For decades conservatives have characterized the whole effort to re-mediate racism by law as itself just another form of racism. We now have a Supreme Court that has put that notion into law.

Good for her. Nice to see someone speaking up as the rest of the court dismantles the United States of America and gives it back to the monarchies … oops, I mean old rich white billionaires.

Roberts thinking: “This hispanic women obviously doesn’t know her place.”

Sotomayor thinking: “These guys obviously have never been in an altercation with a tough women from the mean streets of New York.”

So typical of this regressive court. Scalia and Thomas need to be impeached for starters.

In reality the ruling means very little.

Justice Antonin Scalia also jumped in the mix, writing that Sotomayor's allusion to the Jim Crow era in the context of affirmative action was "doubly shameful."

Classic projection, and the GOP’s most-predictable strategy: Attack your openent (with a straight face!) for doing exactly what you’re trying to get away with.

Scold half the country for “not paying taxes”, while hiding income offshore; condemn unemployment checks as “the dole”, while raking in corporate subsidies; wail about “urban crime”, while handing out bonuses to white-collar gangsters. The list goes on and on…

Its so sad that we have Supreme Court Justices that care more about their partisan allegiance than the law (I’m talking the conservative block, they are the ‘activist judges’)…and I’d say lack of allegiance to the country. This court will be remembered by historians for the damage it did to our way of life.
