You know, that’s a fair point to bring up, but the facts in different cases are different. Given that the entire shooting in this case was on video, it is probably better to compare it to the NY case than the Ferguson case, but even those have major differences–in NY they didn’t shoot the victim and he was alive after the police took him to the ground. The charges that should have been brought in that case would have probably been related to the fact the let the guy die without administering any care when he started having a heart attack. In the NM case, they clearly shot a guy who was trying to run away, who had not attacked anyone.

Easy: by ignoring it.

They had him on tape saying he wanted to shoot Boyd before he was on scene. Still, intent is a difficult element to prove. 'Burkey cops have a bad reputation in a state filled with bad cops.
