The press release says it’s the fourth time they’ve done this, not the ninth.

It doesn’t identify the other three, but earlier press releases do:

Rehnquist (for associate justice, not chief justice), Bork, and Alito.

Hope this brings their average to .500 …

So what’s the count now? I can think of the ABA, the ACLU, Yale Law School, and the Jesuits expressing some degree of reservations about Kavanaugh. At least he still has Trump and the Evangelicals…

Yes, they want him to overturn Roe, yes they want him to drag us all back, but they need him seated for October to rule on that specific case. At stakes is the “separate sovereigns” exception to double jeopardy. If he (and the other 4 conservative judges) vote to overrule it, people given presidential pardons for federal crimes cannot be tried for that crime at the state level. Bam. Trump can pardon the lot of them and they have nothing to fear from state’s attorneys.”

I think the ACLU just had to follow the timeline and apply some simple logic as Nicole Belle did to see that, not only was it likely that Bret Kavanaugh sexually assaulted someone (or someones) but that the GOP knew about it before the hearing began.

From the start, looking at all the evidence in front of us, we come to the incontrovertible conclusion that Brett Kavanaugh is guilty of attempting to rape Christine Blasey Ford – and not only does he know that, the rest of the GOP does, too, and will do anything necessary to hide it and put him on the highest court of the land.

Got it? He KNOWS he's guilty. The GOP KNOWS he's guilty. And they don't care.

So let's look at the timeline, shall we? ...

If Kavanaugh gets confirmed, the ACLU has a big, big problem: a Supreme Court intent on reversing many of the decisions that underpin the ACLU’s legal strategies. The recent decision to uphold the Muslim ban is merely a taste of much larger reverses to come. Troubling times.

I think that goes away anyhow. Yes, in context, we’d like it to persist, but I don’t see that happening. That doesn’t prevent states for prosecuting state crimes outside the constraints of “same crime” though and federal prosecutors can supersede, plea-bargain, or just not charge in cases where a federal pardon is likely.

The ACLU should oppose him on his temperament as well. The way he behaved Thursday should disqualify him from sitting on any bench, including a park bench. I get that he was upset over the allegations, but his behavior should have earned him a 72-hour hold at the local Psych Ward! He laughed, cried, screamed and generally behaved like a privileged little snot that’s never been held accountable for his actions.
