I guess he doesn’t understand that one of the reasons we have a judicial branch is to overturn legislative activities that violate the Constitution. Oh, and the Arkansas judge is certainly not the first one to find the ban on gay marriage to be unconstitutional. Is he suggesting that all of these judges should be impeached? Wow…

When do these alleged ‘Constitutionalists’ understand that ya don’t get to vote on someone’s rights… your rights are what’s in the Constitution… either the State or the Federal…

the FEDERAL overrides the States… get it? any other ‘thing’ is a privilege… you can make rules, ie… pass a driver’s license test or show some other skill for the privilige you seek… like a hunting license… just because you can own a gun it doesn’t give you the right to hunt…

I am confused what some of these people think judges are supposed to do. They are to, at least in principle, follow the Constitution of the State and country in addition to interrupting various law and overturning laws that do not adhere to those. There are alot of things that could pass with overwhelming support that are not ok.

Slavery would have easily passed multiple times in the South. Interracial marriage may still be outlawed in South Carolina. The only way they really can make a claim here would be to revoke all marriage benefits from everyone, saying that marriage is simply a religious institution. Otherwise, judges are obligated to remove such bans.
