If the en banc hearing overturns the decision, I can see the SCOTUS denying cert on this simply out a sense of self preservation . . .

It may still, though. It wasn’t an en banc hearing. It may still be appealed. And yet only one decision continues to be talked about as if it means the ACA is NOW DOOMED.

I’d like to see TPM spend as many words explaining the other decision, its genesis, and its implications, as it has now spent on this decision.
