Trump should be well accustomed to being sued by companies he owes money to. The question is…will he file a counterclaim for $20 million for some bogus made-up reason?

The thing I don’t like about this is that it’s in the Court of Claims. I think the odds against winning there are a lot higher than in the Article III courts.

Much as I dislike the principle of health insurance, I feel very badly for relatively small co-ops like this that are just getting stiffed despite all Federal law and regulation dictating that this should not happen. You have to be pretty desperate to bring this kind of a lawsuit - what this ultimately represents is the loss of coverage for more people. The people allowing this to happen in this way are, quite simply, despicable and bereft of anything resembling empathy. They are the new Republicans.

At first glance this seems like a slam dunk. But I’m sure that Gorsuch can find some originalist interpretation of the text that lets the government off the hook
