How about if you filibuster proceedings on someone you subsequently vote for, you don’t get to vote on the next nomination? (Nah, that wouldn’t work, it would just lead to the loons voting against everybody.)

I think he should definitely wait until after the election. I wouldn’t want to give Republicans yet another issue on which to hit red state Democrats.
During his first term, President Bush nominated 46 people to federal appeals court seats, of which 36 were confirmed. Democrats blocked the confirmation of 10 nominees, on the grounds that they were too “out of the mainstream” for a lifetime appointment. At the beginning of his second term, Bush resubmitted seven of the 10 names. Senate Minority Leader Harry Reid (D-Nev.) vowed to fight their confirmation. Senate Majority Leader Frist threatened to use the nuclear option to get them confirmed.

Senate Majority Whip Mitch McConnell said yesterday that Republicans have enough votes to invoke the “nuclear option” to limit Democrats’ ability to stall by filibuster consideration of President Bush’s nominees for federal appeals courts.
“I never announce my whip count. But I’m telling you, there’s no doubt in my mind — and I’m a pretty good counter of votes — that we have the votes we need,” the Kentucky Republican said. “And that step will be taken sometime in the near future at the determination of the majority leader.”
