I would love to see a montage of clips where Gretchen criticized unions or repeated the Fox bromides “Big union bosses” or “union thugs”. It’s always amusing to see folks bash labor; and yes they are far from perfect yet are ok with having the counterweight to overreaching management.

This issue has existed for decades before Gretchen Carlson was affected by it. Gretchen Carlson was a journalist, supposedly. Never heard her or anyone at her network look into this problem and the abuse of arbitration clauses in non-high end employment contracts like hers.

You beat me to it. What a hero, advocating for all the others affected by an issue that hurts her personally. So how many segments has she done on welfare recipients eating steak and police being intimidated by minorities?

And the family of Tamir Rice got a $6 million dollar settlement from the city of Cleveland for his wrongful death. Don’t talk about justice.

Of course, FOX has a lot more money than the city of Cleveland.

If Carlson not being a complete pariah os what it takes to get political cover for restricting forced-arbitration contracts, then I’ll take that deal.

Btw, ultimately we have the Supreme Court to blame for this mess. They have a long line of infamously pro-corporate contract decisions. (My person favorite was one involving Carnival Cruise lines, where the court upheld a contract provision requiring all suits to be filed in Carnival’s pet jurisdiction, even though customers were not allowed to see the contract until they had paid for a nonrefundable ticket.)

Good for her to come out against forced arbitration but too bad she has to do it in front of a Congressional hearing probably dominated by a majority of GOP pols, all in favor of these horrible arbitration agreements. They are in part the reason we have forced arbitration agreements in big business, due to their unwillingness to put any restraints or regulations on their corporate donors.

Carlson has to look no further than GOP members in Congress that have refused to regulate anything that does business on Wall Street. Corporate Greed is at the heart of these agreements. The GOP have been won over by corporate lobbyists that have gotten their way imposing their clients’ objectives within the Republican Party, who by and large have supported shielding those corporations from lawsuits by their employees.

You can also thank the rightwing justices on the Supreme Court for bans on class-action lawsuits as well due to forced arbitration…Bad wingnut decisions make for bad law…and justice continues to be denied to most employees from the top on down. Settlements are the best most people can usually hope for. And guess who knows this well…the GOP Presidential candidate. That’s been his M.O. for years.

Their work culminated in two Supreme Court rulings, in 2011 and 2013, that enshrined the use of class-action bans in contracts. The decisions drew little attention outside legal circles, even though they upended decades of jurisprudence put in place to protect consumers and employees.

One of the players behind the scenes, The Times found, was John G. Roberts Jr., who as a private lawyer representing Discover Bank unsuccessfully petitioned the Supreme Court to hear a case involving class-action bans. By the time the Supreme Court handed down its favorable decisions, he was the chief justice.
