Senator Grassley, if this is a unique opportunity, doesn’t that mean that it hasn’t happened all that often in our past?

When Justices split, the case they’ve split on remains unsettled. Does that represent a functioning Supreme Court to you, or is it okay in the GOP’s view if the Court is a little bit broken?

If we had nine Justices, and no vacancies, would that prevent Americans from having a serious discussion about the meaning of our Constitution? If so, why?

Speaking of the Constitution, does the use of the word “shall” in Article II, Section 2 give the President and the Senate an affirmative duty to appoint Justice Scalia’s replacement? If so, how can you justify your current actions?

It occurs to me that they’d probably be much better off just openly admitting that they’re holding out hope for a Republican president who’ll nominate someone far more like Scalia than Ginsburg. Just admit it. No one, even those in 100% agreement, actually believes these increasingly idiotic excuses for their obstruction.

True, having a vacancy in and of itself isn’t the anti-Constitution, Pro-ISIS position.

What IS the Pro-ISIS position is to negate the final year of a President’s Term, to pretend that voters only get to vote for 3 Years and NOT the Constitutionally-mandated 4 years.

Grassley is officially taking the position of ISIS, and trying to destroy our Constitution and all it stands for.

Someone remind me when the Senate has ever refused to honor their Constitutional duty to confirm or reject a SCOTUS nominee. I’m betting the answer is never.

I can’t figure why he’s getting all cranky about this. He’s just digging own hole deeper come re-election. If he just shut up and followed McConnell, that’s bad enough, but mouthing off about it only makes it worse for him.

The number of justices on the court is largely irrelevant to this argument.

The President “shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Councils, Judges of the supreme Court”

If the Senate refuses to do their job, they should resign, or be fired by the people.
That is the only argument. No other applies.

It is interesting that the constitution gives the president the authority to nominate and appoint to the court, with the advice and consent of the senate, but says nothing about how many justices there are. That has been set by congress in statute, but grassley just wants to throw up his hands and say whatever, that stuff we pass don’t mean nuthin.

Yeah. If the president had the same attitude y’all be yellin ‘treason’.

Consequently, Grassley has introduced the “Eight Is Enough Act”.

It fixes the number of Supreme Court Justices at their current number.

Until a Republican President is elected, or until Adam Rich finally completes rehab.

Whichever comes first.
