Grassley is not a dummie. Gulliani said:

“In no case can he be subpoenaed or indicted. I don’t know how you can indict while he’s in office. No matter what it is … If he shot James Comey, he’d be impeached the next day. Impeach him, and then you can do whatever you want to do to him.”

Trump’s refusal to be interviewed is highly likely to end up in Court, and very fast at this point. What you DON’T want to do is to be advocating extreme positions. You can be 110% sure that this will be used by Mueller as an example of the fact that Trump’s argument has no limits, and can’t be correct as a result. The end point of a principle ending in extreme outcomes is the best argument that lawyers have that it is NOT a reasonable interpretation of the constitutional principles.

Trump has an argument that he can prevent some types of interference with this authority, and prior decisions like Jones v. Clinton (rejecting that argument that Paula Jones could not depose Clinton) recognize these limits based upon practical considerations. What Giuliani is effectively doing is undermining any claims that Trump will later try to make. Rather than a reasonable argument that e.g. a subpoena would interfere with his authority, he has made this into an argument about whether “Trump is above and not subject to the law.”

This is a stunning tactical and legal mistake. Hard to overstate how bad this is for Trump that this is the ground his “lawyers” (air quotes, Giuliani is not a real attorney) want to fight on.

Grassley is a crank and a cranky old man. In crank mode he can out far right fringewith the most extreme of them. In cranky mode he shows his impatience with this current shit show and makes (usually) hilarious digs at Trump/WH. But whenever cranky shows up and makes it into the media - crank is about to show up within 24 hours (often within hours). Weird sort of sense of balance?

Regardless, Cranky snark aimed at Spanky - made me laugh.

Damned little of what Trump does or says is a mystery. You can tie his actions to some stimuli he’s experienced, like a charged needle touched to a flatworm.

The very fact Trump is tweeting about a self pardon baldly means he’s gaming out scenarios to employ such an act. This is not idle banter. It’s in the works, a fail-safe if needed.
