Discussion: Gorsuch Sidesteps Questions On Whether He Would Uphold Travel Ban

“Judge, do you agree with me that there should not be a religious test in the United States?” Leahy asked.

“I need to know more specifics,” Gorsuch said.

WRONG ANSWER. Right off the bat.

Goddamn shame that this is what we’ll end up with but…

Is this why Ronald Grump, er Donald Trump hates PBS.

Almost certainly a wrong answer–I’m being careful because IANAL—but more than that, a surprising answer.

Some “specifics”:

“No religious test shall ever be required as a qualification to any office or public trust under the United States.” – US Constitution (Article VI, Section 3).

And:

”Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.” – US Constitution (1st Amendment).

Better headline: “Trump SCOTUS Pick Ignorant of 'Specifics’ in US Constitution.”

Someone should ask him about what he would do about Muslim’s on maternity leave…

The questioning is incompetent. Gorsuch should only be asked if there are any circumstances where a ban can be lawful, and draw him out.

The question was phrased poorly. It should have started “under what circumstances is a religious test constitutionally valid in legislation or an executive order”?

You want Questions?
How about:
The Republicans stole the seat you want to occupy by refusing to even have a hearing or a vote
What about the violation of principle and the constitution that allows you to be sitting here today instead of the legal nominee Garland

Seriously how do Democrats not fillibuster this guy until the next election

Seriously don’t they know the precedent.
No Supreme court justice may be nominated by a President who is likely to be impeached.

Ill use The new Trump standard for vetting
I heard it
I saw it on the TeeVee

I’m not going to say anything here that would give anybody any idea how I would rule

Exactly…

Quite a transparent fellow…

Gorsuch insists he has an ‘open mind,’ refuses to reveal views on abortion, guns

He’s deliberately signalling what a dangerous rightwing assh*le he plans to be.

So yes, according to Gorsuch, under certain circumstances, the United States could have a religious test…
Shouldn’t that answer disqualify him off the bat?

John Roberts at his confirmation hearing. There was no way to tell from this that he’d happily shred the Voting Rights Act

“Judges are like umpires,” Roberts said. “Umpires don’t make the rules; they apply them. The role of an umpire and a judge is critical. They make sure everybody plays by the rules. But it is a limited role. Nobody ever went to a ball game to see the umpire.”

Durbin is the first Democrat really giving it to Gorsuch - calling him on cases where he consistently ruled in the minority and always for the large company against the little guy.

I would love for someone to ask Trump about a specific question asked of Gorsuch during this hearing. Make it an easy one. I want Trump, on the record again, to be shown as not actively participating in his role as President so that everyone is reminded it’s not him running the country, it’s an unelected member of his staff.

I smell an Alito clone.

Good observation - Gorsuch has a sense of false piety that I find offensive and is spouting Alito-like rationale for his previous decisions.
