Sen. Flake, take a look at Article 2 section 2. Nothing there says a President cannot nominate in the last year of a term. In fact judges have been nominated and approved in such a scenario. You are just denying reality. Also Do use words like “Nobody really believes that…”. With that phrase you are saying I agree with you. I don’t. You don’t get to say what I believe.
They will do it during the lame duck session. Anyway, there is a very good chance the Democrats won’t take control of the senate. Apparently the Democrats have picked several poor candidates.

This is true, and a telling point about the Republicans. If it were the last year of a Republican presidency, no one - including Democrats - would say what the Republican members of Congress have been saying, that we should bypass Congress’ constitutional responsibility.

Not that long, If he (McConnell) gets lucky. A third of the Senate is up for election every two years, even if they hold this year, they will have to face the voters again in 2018. I doubt the Turtle can hold off hearings for that long. I think Flake is right, and they will take half a loaf during the lame duck, because I’m now pretty confident Secretary Clinton will win the White House. Shameful, but these are Republicans we’re talking about.
I wish Obama would withdraw the nomination after a Clinton victory. Would be sweet payback to Republicans for abandoning their duty. Sadly (in this one instance), I think Obama is far too classy to do that–not only just to do the honorable and correct thing in general, but also to be respectful towards Garland.
My initial read was that he didn’t think Clinton should get a Supreme Court nominee. Not much different than the argument McConnell and Co. pushed since last February.

The Turtle has said categorically that he will not bring up Garland’s nomination in the Lame Duck session. He might not even be majority leader when the next Senate starts. It would be a just irony if that happens. Clinton has indicated that judicial nominations will be a priority on day one if elected.
